TITLE               : Request for consulting services – Selection of an Individual Consultant for the Development of the ECOWAS Regional Petroleum Code.

In the framework of the execution of the 2020 Budget, The Economic Community of West African States (ECOWAS) intends to apply a portion of its budgeted counterpart funds for the Selection of an Individual Consultant for the Development of the ECOWAS Regional Petroleum Code.

  1. The general objective of the assignment is to draw up a regional Petroleum Code establishing the common and specific general provisions governing all hydrocarbon development and exploitation activities in the ECOWAS region.
  2. The consulting services (“the Services”) include the following as shown below and the duration of the contract shall be within six months (One hundred and eighty (180) working days.

Duties and responsibilities of the Consultant will be structured around the following tasks:

  • Carrying out a data collection phase in the 15 ECOWAS Member States in order to collect all the legal and regulatory texts governing the petroleum sector and to share views with competent authorities on policies, regional initiatives and development prospects of the oil and gas sector. The Consultant must meet, during country visits, officials of the Ministry in charge of Petroleum, heads of the national oil companies, the regulatory authorities of the oil and gas sector and any other relevant Institution.

  • Carrying out diagnostic analysis of the existing legal and regulatory framework concerning the hydrocarbon secto The Consultant shall conduct a thorough analysis of the documentation collected in the 15 ECOWAS Member States in order to identify similarities and contradictions. The Consultant shall also highlight, during the review, the difficulties and problems encountered by stakeholders in the management and supervision of oil activities, particularly the monitoring and control of oil activities, management and sharing of revenues, environmental protection, management of border conflicts, local content among others.
  • Developing the ECOWAS Petroleum Code: Following the in-depth analysis of the legal and regulatory framework of the hydrocarbon sector in the 15 ECOWAS Member States and based on the diagnosis established, the Consultant shall propose a draft regional petroleum code integrating regional specificities and in line with international best practices. The petroleum code shall propose a set of innovations taking into account constraints relating to the efficient exploitation of oil resources in the region. The Consultant shall prescribe harmonised provisions based on the existing ones in Member States and covering the entire upstream oil value chain. The draft petroleum code must take into account:
  • international best practices in petroleum legislation;
  • the economic, social and geographic realities of the member states of the region;
  • Incentive and attractive measures to contribute to the dynamism and development of the region’s petroleum sector.

  1. The ECOWAS Commission now invites eligible Individual Consultants (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

 

The shortlisting criteria are as follow: The study will be carried out by one (1) consultant with the following profile:

  • He/She must have a master’s degree in law, legal sciences, Petroleum Engineering or related field (a higher degree would be an advantage), with at least 10 years of experience in the drafting of legal texts organising the petroleum sector as well as the experience in the implementation of legal reforms, within an international or national oil company, a law firm or a government.
  • He/she must have at least two (2) specific experiences in drafting petroleum code during the last 10 years, in an oil producing or non-producing country ;
  • Good understanding of hydrocarbon exploration and exploitation activities, and knowledge of relevant international legislation and regulations;
  • Good command of the petroleum’s administrations and industries;
  • Perfect command of French or English and a good knowledge of the other language;
  • Good writing skills and proven ability to prepare and present technical documents.

NB: The attention of interested Individual consultants is particularly drawn to Article 118 of the ECOWAS Revised Procurement Code (“Infringements by Candidates, Bidders and Awardees”), providing information on corrupt or fraudulent practices in competing for or executing a contract.  In addition, please refer to the following specific information on conflict of interest related to this assignment as per “Article 119 of the ECOWAS Revised Procurement Code.

  1. The Consultants will be selected in accordance with the Selection of Individual Consultant set out in the Consultant Guidelines.
